Attorneys L. David Green and Matthew M. Terry secured a denial of a workers’ compensation claim on behalf of the Employer/Respondent following a trial in Peoria, Illinois. Petitioner claimed he suffered a right shoulder injury while working for the Employer/Respondent and requested temporary total disability benefits of $16,578.71 as of the time of trial, requested approval of and payment for a right shoulder surgery, and in all likelihood ongoing and future temporary total disability benefits. The Arbitrator denied Petitioner’s claim in its entirety, mainly due to extensive information Mr. Green and Mr. Terry were able to obtain before trial and which was used at trial to support their position Petitioner’s claim should be denied. Petitioner appealed the Arbitrator’s decision to the Illinois Workers’ Compensation Commission and after the parties filed briefs and presented for oral argument the Illinois Workers’ Compensation Commission affirmed and adopted the Arbitrator’s decision in its entirety denying compensation.
