Attorneys William J. Knapp and Mark W. Dinsmore II secured a defense verdict on behalf of Assisted Housing Risk Management Association (“AHRMA”) following a week-long trial in June 2018. AHRMA was sued by Plaintiff which had claimed that AHRMA had breached a contract when AHRMA denied a damages claim made by Plaintiff under a Coverage Agreement following a 2010 storm event. AHRMA argued that various evidence existed supporting its position that provisions contained within the Coverage Agreement excluded coverage for the Plaintiff’s claimed damages. After deliberating, the jury returned with a defense verdict favoring AHRMA and found that Plaintiff was not provided coverage for its claimed damages. Following the jury trial, Plaintiff appealed to the Fourth District Appellate Court in Springfield, Illinois arguing that the trial court committed numerous errors both in pre-trial rulings and during the trial. Plaintiff sought judgment as a matter of law on various issues and a new trial. Briefs were filed and subsequently oral arguments were presented by the parties on March 11, 2020, with Mark W. Dinsmore II arguing on behalf of AHRMA. Following oral argument, the Fourth District Appellate Court took all arguments under advisement. On April 13, 2020, the Fourth District Appellate Court affirmed the judgement of the trial court.
